Overview

A report on the Planning Proposal for 322 Stuarts Point Road, Yarrahapinni was tabled at the Ordinary Council Meeting of 20 August 2024 (10.1 Planning Proposal - 322 Stuarts Point Road, Yarrahapinni - PP2300004).

From that meeting, Council resolved:

That Council:

1. notes the amendments to the Planning Proposal PP2300004 which seeks to amend the Zoning and Lot Size Map at Lot 333 DP 805299, 322 Stuarts Point Road, Yarrahapinni;

2. places the amendment to Kempsey Development Control Plan 2013 (draft Chapter D6 – Yarrahapinni Land Release Area) on public exhibition for a minimum period of 28 days;

3. endorses the progression of the Planning Proposal to the making of the amendment the Kempsey Local Environmental Plan 2013;

4. authorises the General Manager to exercise delegation from the Minister for Planning to make the amending instrument; and

5. requests the Department of Planning, Housing and Infrastructure notify the plan on the NSW Legislation webpage upon the making of the Kempsey Local Environmental Plan 2013 amendment.

What is Chapter E4 of the DCP

This Development Control Plan Chapter applies to all development on land located at Lot 333 DP 805299, Yarrahapinni, as shown in the attached documents.

Note: (that the chapter number has changed from ‘D6’ to ‘E4’)

The provisions of this Chapter override the provisions of any other Chapter of this DCP, to the extent of any inconsistency. Development applications will need to be assessed against the provisions of any other relevant chapter of this DCP, in addition to this chapter.

The objectives of this Chapter are:

  1. To encourage appropriate development, which is sensitive to the environmental values of the land.
  2. To ensure appropriate management of environmental zoned land.
  3. To protect riparian areas and key fish habitats.

Next steps

Once the exhibition period has closed, all feedback will be considered and form part of the review process.
